- A sperm recipient must be the wife of a couple undergoing infertility treatment of whom the husband is infertile, or be a single woman who wishes to have a baby and whose eggs are of good quality for conception.
- An ovum recipient must be Vietnamese or of Vietnamese-origin who is the wife of a couple undergoing infertility treatment and who has no ovum or whose ovum are of poor quality for conception.
- An embryo recipient must be one of the following:
- The wife of a couple undergoing infertility treatment, both of whom are infertile;
- The wife of a couple undergoing infertility treatment who has unsuccessfully applied in vitro fertilization, except in cases of gestational surrogacy.
- A single woman who has no ovum or whose ovum are of poor quality for conception.
- A sperm, ovum or embryo recipient must be physically fit for in vitro fertilization, pregnancy and childbirth; currently suffer from no sexually transmitted diseases, HIV infection, or contagious diseases of group A or B; have no hereditary diseases which can affect subsequent generations; and have no mental or other disease which deprives her of the capacity to perceive and control her behavior.
- Medical examination and treatment establishments may not provide names, ages, addresses and images of sperm, ovum or embryo recipients.
