What is a married person?

According to Joint Circular 01/2016/TTLT-TANDTC-VKSNDTC-BTP, a married person is:

  • A person who was married in accordance with the law on marriage and family and has not divorced or there is no event of his/her spouse being deceased or his/her spouse has not been declared deceased;
  • A person who established a husband-and-wife relationship with another before January 3, 1987 without marriage registration and has not divorced or there is no event of his/her spouse being deceased or his/her spouse has not been declared deceased;
  • A person who was married despite not satisfying the marriage conditions as prescribed in the Law on Marriage and Family but the marriage has been recognized by a valid judgment or decision of the Court, and he/she has not divorced or there is no event of his/her spouse being deceased or his/her spouse has not been declared deceased.
