The support obligation between husband and wife is a humanitarian relationship of Vietnamese law, this relationship stems from the love of the husband and wife. With the aim of assisting a spouse who is in difficult or needy circumstances after the divorce, and to ensure that there is property to stabilize his or her life, the 2014 Law on Marriage and Family provides for a stipulates the support obligation between the husband and wife as follows:

The support obligation between the husband and wife arises when the following conditions are met:

• When the husband or wife are facing financial difficulties, challenging circumstances or requesting support for plausible reasons;
• A husband or wife has the ability to perform the maintenance obligation.
