Which parent’s rights can be restricted and what is the time of restriction?

According to Clause 2, Article 85 of the 2014 Law on Marriage and Family, in cases where a parent’s rights toward a minor child are restricted under the decision of the Court, the following rights will be restricted:

  • Custody of their child;
  • Caring for their child;
  • Educating their child;
  • Managing their child’s separate property;
  • Acting as the child’s legal representative.

These rights will be restricted from 1 to 5 years. However, the Court may consider shortening this period of time if the person being restricted corrects or remedies the violation.
