Who are the persons entitled to request the Court to restrict a parent’s rights toward a minor child?

The 2014 Law on Marriage and Family lists the persons entitled to request the Court to restrict a parent’s rights toward a minor child:

  • Parents or guardians of minor children;
  • Next of kin;
  • The State management agency in charge of families;
  • The State management agency in charge of children;
  • The Women’s Union.

Other individuals, agencies and organizations, upon detection of a parent committing violations of Clause 1, Article 85 of this Law, have the right to request the agencies and organizations prescribed at Points b, c and d, Clause 2 of this Article to propose that the Court restrict this parent’s rights toward the minor child.
