How is the matrimonial property regime of spouses restored after the common property is divided during the marriage period?

In case the husband and wife have divided the common property and wish to restore the matrimonial property regime, the husband and wife must agree in writing, and the agreement must contain the following:

  • Reasons for the restoration of the matrimonial property regime;
  • The separate property;
  • The common property, if any;
  • Effective time of the restoration of the matrimonial property regime;
  • Other contents.

The document must clearly state the date of the agreement and must be signed by both husband and wife. The written agreement may be witnessed by witnesses, notarized or certified at the request of the husband and wife or as prescribed by law.
