If the Court has made a judgment to restrict the inheritance rights of other heirs at the request of the surviving spouse, when are these heirs entitled to request that inheritance?

In the following cases, the other heirs have the right to claim the division of the inheritance:

  • Expiration of the time limit determined by the Court;
  • The spouse is already married to another person;
  • When the surviving spouse performs transactions with the aim of dispersing or damaging the estate.
